Here’s the steps to reproduce the issue:

  1. have a powerful computer capable of doing 150-200+ fps
  2. set the fps limit to say 60 or 80 or any lower value
  3. watch the fps constantly going above set limit very frequently
  4. non-stop stutter game play

This happened to me several times in the past with former builds AND the current Public Preview from may; were you using the Public Preview patch or the stable build?
Since more than just one game/app did not lock properly fps to the values I wanted and specified through graphics driver settings, I started using Bandicam, and then that app limited them to what I wanted. It is not ideal to use a third party app, but can force apps to run at desired values, including Age of Empires II.
The “lock fps to a specific value” should be treated as a priority among other issues, as it is an integral part of the settings, specially relevant to those not having powerful PCs or that are having hardware issues or incompatibilities with certain brands (like AMD for example, wich is in my case, and with this game it has been reported that the game did not work as axpected).

this im not sure. it went away for a day or two but now is back so don’t really know the cause and I dont have windows update enabled, even reverted to previous working image with no such issue only to have this issue. so the problem is very likely the game itself

Yeah, I don’t believe a third-party app or even a Windows one could cause a particular setting change in the game, or really ANY game… unless it has to do with frame rates or additional, more complex tweaks.
