Is this not a result of the first crusade technology? That is intended behavior afaik

I agree; the population and housing cap is only intended to prevent the training of units whose training have not started, and the placing of Feitorias. It doesn’t prevent techs like First Crusader.

You can also see this effect if you use a monk at 200 pop to convert enemy units, or if you have a certain pop and delete all your houses; you won’t lose your units and you’ll be over your housing cap.
